BARDEN HOTEL DISTANCE SALES AGREEMENT

ARTICLE 1: PARTIES

1.2. BUYER (Consumer): The person who makes a reservation through the website (www.bardenotel.com.tr) and declares their personal information on the form.

ARTICLE 2: SUBJECT

The subject of this agreement is to determine the rights and obligations of the parties in accordance with the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts regarding the sale and performance of the accommodation service, the characteristics and sales price of which are specified, reserved by the BUYER in an electronic environment via the SELLER's website.

ARTICLE 3: SERVICE AND PRICE OF THE AGREEMENT

  1. 3.1. Type of Service: Hotel Accommodation Service.
  2. 3.2. Agreement Price: The total amount specified in the reservation confirmation form (including VAT and accommodation tax).
  3. 3.3. Payment Method: Credit card, debit card, or other payment methods approved by the SELLER.

ARTICLE 4: GENERAL PROVISIONS

  1. 4.1. The BUYER acknowledges that they have read and informed themselves about the basic characteristics of the service, the sales price, the payment method, and the preliminary information regarding the accommodation on the website, and has provided the necessary confirmation in the electronic environment.
  2. 4.2. The SELLER is responsible for providing the service subject to the agreement in a flawless manner and in accordance with the qualifications specified in the reservation.
  3. 4.3. Check-in time is at the earliest 12:00, and check-out time is at the latest 12:00.
  4. 4.4. The BUYER is personally responsible for any damage caused to the hotel fixtures during the stay.

ARTICLE 5: CANCELLATION, REFUND, AND MODIFICATION TERMS

  1. 5.1. Cancellable Reservations: For cancellations made at least [7] days prior to the arrival date, the full amount paid shall be refunded to the BUYER.
  2. 5.2. Late Cancellation/No-Show: In case of cancellations made less than [7] days before the arrival date or if the guest does not show up (No-Show), [the first night's stay / the total amount] of the total accommodation fee will be charged as a penalty.
  3. 5.3. Early Departure: If the BUYER terminates the service after the stay has commenced, they may request a refund for the remaining days subject to the SELLER's approval (Discounted or promotional prices are excluded).
  4. 5.4. Refund Process: Refunds are made to the card/account used for payment by the BUYER within 14 business days from the date of cancellation approval.

ARTICLE 6: RIGHT OF WITHDRAWAL

Pursuant to Article 15, paragraph (g) of the Regulation on Distance Contracts, the consumer does not have the right of withdrawal in contracts regarding accommodation, transport of goods, car rental, food and beverage supply, and leisure activities which must be performed on a specific date or period. Cancellation procedures are carried out only within the framework of the rules in Article 5.

ARTICLE 7: AUTHORIZED COURT

In the implementation of this agreement, Consumer Arbitration Committees are authorized up to the value declared by the Ministry of Trade each year; for values exceeding this threshold, Siirt Consumer Courts and Execution Offices are authorized.
